Last week we discussed whether you needed a lawyer and whether you had planned ahead and considered this question BEFORE the need arises and when you are not stressed. We then discussed how important a good Med/Legal report is to maximizing the value of an accident case.

This report is the single most important factor in getting more money for an injury victim and should be written as a report, not a summary of notes. Most “local” doctors fall into this category…and have unknowingly been writing reports wrong for years,…thus unknowingly decreasing the value of CV patient’s Accident cases. When we don’t get enough money on a soft tissue cases, we have to beg the doctor to reduce their bill.

There is an art to writing a helpful med legal report. For years Gribow was a Faculty member at the annual International College of Orthopedic Surgeons Conference where he taught, “How to Write a Med/Legal Report” at their Annual Conference in Beverly Hills. Each doctor was gifted his 50 page Treating Physicians Manual, providing an “update on the management of back pain and back injury.”

Unfortunately most doctors don’t realize that stating the patient has recovered and is ok, or symptom free…is the KISS OF DEATH for the client… and attorney. Instead, they should consider, “Prognosis is Guarded.”

 

Doctors must understand the Insurance companies only pay those damages the patient is able to prove are from the accident. When describing your injuries, it’s best not to say “I can’t do…” Instead consider, “It hurts when I try to…”; “I am not able to do it as well”. The Medical Report arguably should read, there is a 50% chance, the patient will not make a full recovery, rather than a 50% chance of a full recovery. Gribow has also lectured to local colleges.

Here are  a few reasons to retain an a lawyer. S/he advises and recommends you on correct decisions and

  1. Prepares and investigates.
  2. Stop Adjusters calls
  3. Gets a Body Shop
  4. Helps with Lien Medical Treatment
  5. Gets the Police Report
  6. Pays Costs
  7. Advises you regarding social media, usually meaning take down all social media.
  8. Investigate and collects evidence.
  9. Find all insurance coverage.
  10. Gets medical bills paid.

  14. Advise whether to accept offers or counteroffer.

  16. Negotiate settlement with insurance companies
  17. Prepare for trial…if no good offer.  
  18. Most importantly, a lawyer who can assist local CV Doctors who were not taught How to Write a  Med/Legal Report in their Medical School.
